Microsoft and HIPAA ?

I just read a post off of usenet that stated microsoft's EULA is not HIPAA compliant.

Can someone please put my somewhat jittered nerves to rest?

How are all of you dealing with encryption? Specifically with your database?? I've tried implementing RC4 but I'm executing at 50 to 75 msec.. ouch .

Any suggestions?
